The Risks Involved with Unauthorised Building Works...

Tuesday 10 June 2025

Unauthorised building works are work that have been undertaken on your property without the required planning or building approvals.

On some cases, a person may unknowingly purchase a property that includes unauthorised works and the associated liability.

In NSW, depending on the nature and extent of the works, they may be eligible for retrospective approval through a Building Information Certificate application submitted to the local Council. Despite this, Councils retain the authority to issue compliance orders, impose fines, or, in some instances, require the demolition of of the illegal works.

Parker Scanlon’s Town Planning team can assist you in navigating the complexities of a Building Information Certificate by liaising directly with Council and acting on your behalf to achieve an agreed outcome for all parties
